Competition rules and photo licence

Draft for review. This text has not been through counsel.

Who can enter

Open to adults 21 and over. Free to enter — no purchase is necessary, and buying something does not improve anyone's chances. Employees of alcoholic beverage retailers and wholesalers, and their families, may enter but cannot receive a prize (27 CFR 6.96). No prize is alcohol.

Your photograph

You must have taken the photograph yourself and have the right to give it to us. By entering you grant Cape Charles Winery a non-exclusive, worldwide licence to show your photograph and the engraving made from it on this site, in print and in advertising, with credit to the first name you give us. You keep the copyright. You can withdraw an entry at any time by replying to the email we send you, and we will remove the image, the engraving and anything derived from them.

Children

We never tag or name an identifiable child. A photograph with an identifiable child in it goes to a person for review, and the default is not to publish it beside the brand. Children seen from behind, as on our labels, are the house standard.

Location

We read the location your camera recorded so we can print where the photograph was taken. If it is within 250 m of a public landmark we print the landmark's coordinates; otherwise we round to the nearest arc-minute. Exact coordinates are only ever printed if you ask for them. Published images have their location data stripped out.

The winning label

One entry each year becomes a label. A new photograph on a label is not an allowable revision: it needs a new Certificate of Label Approval filed by our bottling winery and a Virginia ABC label approval before it can be printed or shown in advertising. Until then, every entry — including a winner — carries the line "A competition entry, not an approved label."
